The main difference EU GPSR and the old EU GPSD? It is that the new General Product Safety Regulation provides a new legislative framework: in contrast to the GPSD, the GPSR will take the form of a Regulation. It is expected by Q4 of 2024 and shall be immediately applicable in all Member States. There will be less state variability, even if we anticipate that Member States may also adopt certain restricted norms to implement the GPSR. The GPSR, like the Radio Equipment Directive, will complement existing product-specific laws as well as laws governing surveillance, such as the EU Market Surveillance Regulation 2019/1020.
To the extent that its obligations are not already addressed by this other legislation, it will be applicable. The Digital Services Act and the EU Representative Actions Directive (EU) 2020/1828 are two more recent legislations that the GPSR complements or otherwise refers to.
